We need to process your personal data in order to provide you with the loan that you are applying for. If you do not provide this information, then we will be unable to provide you with a loan. We will not collect or otherwise process any information about you that we do not need in order to provide and administer your loan.

We need to process your personal data in order to provide you with access to the finance that you are applying for. If we do not have access to the relevant information contained in the data that you provide either directly to us or via a third party, then we will be unable to provide you with a loan.

We will not process any information about you that we do not need in order to provide and oversee the loan that you are applying for.

Our role as Data ControllerWe act as data controller for all of the personal data that we receive either directly from customers or that has been provided to us by an intermediary such as a finance broker – in order to provide Hire Purchase Loans and Fixed Sum Loans.
 

We only process information about you that is necessary for us to provide you with a loan (Hire Purchase or Fixed Sum Loans).

Contract

Where you are entering into a loan agreement with us – it is necessary for us to use your personal information to carry out our due diligence as part of agreeing to provide you with the funds that you have requested. In these circumstances your data is being processed as it is necessary for the purposes of entering into a contract.

Legitimate Interests
Data protection law also allows us to process personal information for our genuine and legitimate reasons as long as we respect your rights and freedoms. Such uses include retention of your personal data collected to support your loan agreement for a minimum period of time to protect the legitimate interests  of Evolution Loans Ltd.  We will always carefully consider and balance any possible effect this may have on you and your rights.

All the personal data we hold about you will be processed by us and systems in the United Kingdom.   Your data will never be processed, by us or our suppliers, outside the EEA.

Your information may be passed to third parties, where required, in order to support the loans that you have applied for, as well as where there is a legal obligation for us to provide third parties with this information e.g. The FCA or The Police, to prevent, detect, investigate and prosecute fraud, alleged fraud, money laundering and other crimes.

We will use your data to process your application for a loan and for the management of your loan. This processing may include:

Customer Services

Call recording and monitoring

We may monitor or record calls, emails, SMS messages or other communications for:

  • Quality control and ensuring effective operation of our processes and systems.
  • Processing necessary for entering into or performance of your contract for a loan.
  • Meeting our regulatory obligations.
  • Prevention or detection of crime.
  • For the legitimate interests of the data controller.
Administration of our Loan Services

Monthly reports to Credit Reference Agencies

As part of administering your loan with us we make regular submissions to credit reference agencies such as Equifax, Call Credit and Experian on the performance of the loan.  The data that we process relates solely to your loan agreement:

  • Agreement number
  • Your name
  • The amount borrowed
  • The balance of your loan
  • Length of your loan agreement
  • Monthly instalments due
  • The status of your payments

Neither Evolution Loans Ltd nor any of its data processors will ever send customer data for processing outside of the EEA. We also work with our chosen data processors to ensure that they (and any sub-processors that they may use) have a commitment to processing personal data within the UK and the EEA.

When we process your personal information, the length of time we retain it is determined by the purpose for which we use that information and our legal and regulatory obligations.

Once we have established that we no longer require the information for the specified purposes for which it was collected or the purposes outlined below, we would delete it.  We would not retain personal information in an identifiable format for longer than is necessary.

Other determinants for the length of time that we retain your personal information are:

  • Our legitimate interests and the need to use your personal information to establish, bring or defend legal claims,
  • The requirement by law or regulation for us to hold your personal information for a longer period, or to delete it sooner,
  • Your decision to exercise your right to have the information erased (where this applies).

Information about your loan agreement may remain on file for up to 15 years after your successful application for funding.

If your application for a loan is refused, or you decide not to proceed with your submitted vehicle finance application then we may still retain your information for up to three years.

As a data subject, the data protection law affords you the following rights related to your data and how it’s processed:

The right to be informed – this means we must provide, at the point of collecting your data, a privacy notice (this document) informing you of how your personal information will be used.

The right to access your personal information – this means that you have the right to know what information we hold about you, and to request a copy of it. This information is provided free of charge.

Data accuracy – The right to get inaccurately recorded information corrected.

The right to erasure – this means that you can request that your personal data is deleted from our records, also referred to as ‘the right to be forgotten’.

The right to restrict how your personal information is used – this means that you have the right to object to how we use your personal information, including for direct marketing purposes.

The right to receive your personal information in a legible and transferable format – this means that you can make a reasonable request for your data to be sent to you in a format that is accessible to you.

The right to object to the use of your personal information – This right applies unless we can demonstrate compelling legitimate grounds for continuing to process your data.

Rights related to automated decision making including profiling – this means you have the right to object to your personal information being used to make a decision based on an automatic process without human intervention.

We are committed to ensuring that your information is secure.

In order to prevent unauthorised access or disclosure we have put in place suitable physical, technological and managerial procedures to safeguard and secure the information we collect.

It is also a condition of our contracts with any data processors that they and their sub-processors have appropriate security measures in place to protect the data being processed on our behalf.

Our security measures are continually improved in line with technological developments.
